Article 1: About the Terms of Use
- These Terms of Use (hereinafter referred to as these "Terms") define the conditions of use, precautions, and other matters regarding the service "NSD Ticket Center" (hereinafter referred to as the "Service") provided by Nippon Ski Resort Development Co., Ltd. (hereinafter referred to as the "Company").
- Users of the Service (hereinafter referred to as the "User" or "Users") must review and agree to the contents of these Terms in advance. By using the Service, the User shall be deemed to have consented to all the provisions stated in these Terms.
- The Company shall be entitled to modify these Terms without the prior consent of the User. The modified Terms of Use shall become effective from the time they are displayed on the Service. If the User continues to use the Service after any modification to these Terms, the User shall be deemed to have consented to the contents of the modified Terms. Furthermore, the Service includes the provision of services under specific conditions utilizing external identity verification services. The User shall understand and agree to such mechanism and the relevant provisions of these Terms upon using the Service.
Article 2: User Registration
- User registration shall be completed when an applicant for registration applies for registration by the method designated by the Company and the Company approves the application.
- If the Company determines that the applicant for user registration falls under any of the following items, the Company may choose not to approve the application for registration, and the Company shall bear no obligation to disclose the reasons for such refusal:
(1) If false information was reported at the time of application for user registration(2) If the application is from a person who has previously violated these Terms(3) In any other case where the Company deems the user registration to be inappropriate
- If the Company determines that the applicant for user registration does not satisfy the identity verification or other conditions designated by the Company, the Company may restrict user registration or the use of certain services.
Article 3: Digital Tickets
- Tickets such as lift tickets that can be purchased through the Service (hereinafter referred to as "Digital Tickets") can be utilized by exchanging them for actual lift tickets, etc. (hereinafter referred to as "Physical Lift Tickets, etc.") at the local ski resort. Please note that Physical Lift Tickets, etc. will not be sent by mail or postal services.
- Digital Tickets cannot be changed, canceled, or refunded for any reason whatsoever.
- Digital Tickets cannot be resold or transferred to any third party for any reason whatsoever.
- In the Service, available ticket types, prices, purchase quantities, and other sales conditions may vary depending on the User's attributes, identity verification status, and other factors.
- Specially priced tickets provided only to Users who satisfy specific conditions may be purchased only when the identity verification and other conditions designated by the Company are fully satisfied.
- Furthermore, when exchanging Digital Tickets for Physical Lift Tickets, etc. at the local ski resort, the Company shall be entitled to request the User to present identification documents, etc. again. If the User does not comply with such request, or if it is found that the User does not satisfy the required conditions, the Company shall be entitled to refuse the exchange for Physical Lift Tickets, etc.
Article 4: Management of User ID and Password, and Maintenance of Usage Environment
- The User shall manage their own User ID and password for the Service entirely at their own responsibility.
- Under no circumstances may the User transfer or lend their User ID and password to any third party.
- When a login is performed with a combination of User ID and password that matches the registered information, the Company shall deem it to be used by the User who registered that User ID.
- The User shall, at their own responsibility and expense, appropriately maintain all equipment, software, and communication methods necessary to utilize the Service.
- The User shall implement security measures such as preventing computer virus infections, unauthorized access, and information leakage according to their own usage environment.
- The Company shall not be involved in any way with the User's usage environment and shall bear no responsibility whatsoever.
Article 5: Prohibited Matters
- The User shall not engage in any of the following acts when using the Service:
(1) Acts that violate laws, regulations, or public order and morals(2) Criminal acts, or acts that forewarn, encourage, or are involved in criminal acts(3) Acts that destroy or interfere with the functions of the Company's servers or networks(4) Acts that risk interfering with the operation of the Company's services(5) Acts that collect or accumulate personal information, etc., regarding other Users(6) Acts of impersonating another User(7) Acts that directly or indirectly provide benefits to anti-social forces in connection with the Company's services(8) Acts aimed at acquiring illegitimate profits through the use of the Service, or acts equivalent thereto(9) Acts of utilizing the Service for commercial or profitable purposes, whether in whole or in part(10) Acts of reselling or transferring Digital Tickets purchased through the Service(11) Acts that circumvent or illegitimately utilize the mechanism of external identity verification services(12) Acts of utilizing the Service by forging or altering identity verification information, or by impersonating another person(13) Acts aimed at illegitimately evading special prices or purchase restrictions(14) Other acts that the Company deems inappropriate
Article 6: Suspension of Provision of the Service, etc.
- If the Company determines that any of the following events occur, the Company shall be entitled to suspend or interrupt the provision of all or part of the Service without prior notice to the User:
(1) When performing maintenance, inspection, or updates of the computer system related to the Service(2) When the provision of the Service becomes difficult due to force majeure such as earthquakes, lightning strikes, fires, power outages, or natural disasters(3) When computers, communication lines, etc. stop due to an accident(4) When a failure, suspension, specification change, etc. occurs in external identity verification services(5) In any other case where the Company determines that the provision of the Service is difficult
- The Company shall bear no responsibility whatsoever for any disadvantage or damage suffered by the User or a third party due to the suspension or interruption of the provision of the Service, regardless of the reason.
Article 7: Restriction of Use and Deregistration
- In the following cases, the Company shall be entitled to restrict the use of all or part of the Service or deregister the User without prior notice:
(1) If the User violates any provision of these Terms(2) If it is found that the registered information contains false facts(3) If any deficiency, illegitimacy, or falsehood is found in the identity verification information(4) In any other case where the Company deems the use of the Service to be inappropriate
- The Company shall bear no responsibility for any damage caused to the User due to acts performed by the Company based on this Article.
Article 8: Disclaimer of Warranties and Limitation of Liability
- The Company's default liability shall be exempted unless it is due to the intentional act or gross negligence of the Company.
- The Company shall bear no responsibility whatsoever for any damage caused to the User arising from third parties (including telecommunication carriers and other business operators).
- In the use of the Service, if any dispute arises between the User and a third party, the User shall resolve such dispute and compensate for damages at their own expense and responsibility.
- In the use of the Service, if there is an infringement of the rights of a third party by the User, and the Company incurs damages or other expenses in connection with responding to the third party, the User shall bear such damages or expenses.
- The Company shall bear no responsibility whatsoever for any damage caused by additions to, modifications of, or the interruption or termination of the Service. The same shall apply even if a decrease in display speed or failure occurs due to excessive access or other unexpected factors.
- If the Company determines that there is a reasonable ground to believe that an act violating these Terms or an act carrying such risk has been committed, the Company may execute compulsory withdrawal of the User, delete all or part of the information related to the User, or change the disclosure range, but the Company shall bear no responsibility whatsoever for any damage caused thereby.
- Except in cases of intentional acts or gross negligence by the Company, the Company shall bear no responsibility whatsoever for any damage caused to the User due to the provision status, authentication results, delays, interruptions, or suspension of external identity verification services.
- Except in cases of intentional acts or gross negligence by the Company, the Company shall bear no responsibility even if specific products, prices, or services could not be utilized due to the success or failure or results of identity verification.
Article 9: Modification of Service Contents, etc.
- The Company shall be entitled to modify the contents of the Service or discontinue the provision of the Service without notice to the User, and shall bear no responsibility whatsoever for any damage caused to the User thereby.
Article 10: Handling of Personal Information
- The Company shall appropriately handle personal information in accordance with the "Privacy Policy" separately designated by the Company.
- The Company may acquire and utilize information regarding the User through external identity verification services within the Service, and the handling of such information shall follow the "Privacy Policy" separately designated by the Company.
Article 11: Validity of These Terms of Use
- Even if a part of the provisions of these Terms is determined to be invalid based on laws and regulations, the other provisions of these Terms shall remain valid.
- Even if a part of the provisions of these Terms is rendered invalid or canceled in relation to a specific User, these Terms shall remain valid in relation to other Users.
Article 12: Assignment of Rights and Obligations
- The User may not assign, transfer, set collateral, or otherwise dispose of their rights or obligations based on these Terms to any third party without the prior written consent of the Company.
- In the event that the Company transfers the business related to the Service to another company, the Company shall be entitled to assign its contractual status, rights, and obligations based on these Terms, as well as registration information and other information to the transferee of such business transfer, and the User shall be deemed to have consented to such transfer in advance.
Article 13: Governing Law and Jurisdiction
- The governing law of these Terms shall be the laws of Japan.
- In the event that a lawsuit becomes necessary between the User and the Company, the Nagano District Court shall be the exclusive agreement jurisdiction court of the first instance.
